Retaliation occurs when an employer discriminates against an employee for
exercising a legal right. Here, Ed, as a Californian employee, has the right to
a smoke-free work place and the right to complain about second-hand smoke at
work without fear of retaliation by his employer. Ed has a retaliation claim.
Whistleblowers who report suspected misconduct to their employer rather than to
